Payment Terms and Conditions

This Payment and Refund Policy is a legally binding agreement between you ("Customer," "You," or "Your") and Zynetic Electric Vehicles Charging Pvt Ltd ("Zynetic Electric Charging," "We," "Us," or "Our") for services provided by Zynetic Electric Vehicles Charging. By using our digital platforms or services, you acknowledge that you have read, understood, and agreed to the terms and conditions outlined in this policy. If you do not agree to these terms, please do not use our services.

Payment Terms and Conditions

1. Nature of Wallet

The Zynetic Electric Vehicles Charging Wallet is a Closed System Prepaid Instrument ("PPI") designed for the purpose of purchasing Zynetic Electric Vehicles Charging services. This wallet is exclusively used for our services and cannot be exchanged for cash or used to purchase third-party services.

2. Personal Identification Number (PIN)

To access our services, you may be required to generate a personal identification number (PIN), which may include a numeric password or alphanumeric combination. You are responsible for maintaining the confidentiality of your registration data, including the PIN. Any activities or transactions occurring through your account, whether initiated by you or a third party, are your responsibility. Your account is non-transferable.

3. Use of Account

It is your responsibility to take reasonable precautions to prevent misuse of your account. You are liable for any consequences arising from the unauthorized use of your account. If you suspect unauthorized use, please inform us at support@zynetic.com. Your liability for unauthorized payment transactions will be limited as per the directions of the applicable regulations.

4. Card Payment

Zynetic Electric Vehicles Charging enables the use of payment cards for our services. Please ensure the accuracy and validity of the card details you provide. Zynetic Electric Vehicles Charging is not liable for false, incomplete, or incorrect card details. Eligible cards may vary based on your location and the device you are using.

5. Unified Payments Interface (UPI)

Zynetic Electric Vehicles Charging may provide access to UPI services provided by third-party service providers. Your usage of UPI and mobile wallets is subject to the terms and conditions of these third-party providers, and Zynetic Electric Vehicles Charging assumes no liability in this regard.

6. Promotions and Discounts

Zynetic Electric Vehicles Charging may provide information about services, discounts, and promotions to you through our digital platforms, SMS, or email. You have the option to discontinue receiving such information at any time.

7. Affiliated Merchants

The Zynetic Electric Vehicles Charging wallet can be used only for services provided by Zynetic Electric Vehicles Charging. We do not take responsibility for the quality of third-party services or additional products offered by merchants in addition to our services.

8. Refundable Deposit

Zynetic Electric Vehicles Charging may require a refundable deposit for the activation or reactivation of our services. We will refund your deposit, minus any outstanding amounts or costs, as required by law. We will process this refund within 45 days of the eligible circumstances.

9. Settlement of Accounts

If you are a ChargePoint Owner or Host, Zynetic Electric Vehicles Charging will collect charging session fees from end users and pay them to you. We will settle payments within T+7 days. In case of a dispute, you can contact us at support@zynetic.com. If we fail to pay within 30 days of the transaction, you are entitled to interest at a rate of 18% per annum. However, this applies only if transactions are settled through our online platforms.

ChargePoint Owners or Hosts are entitled to charge a service fee in addition to energy usage fees. Zynetic Electric Vehicles Charging is not liable for electricity bills or infrastructure charges.

‍

If you are an end user of a ChargePoint, you agree to pay session fees, service fees, platform fees, and applicable taxes. You authorize Zynetic Electric Vehicles Charging to deduct the final amount after every session. Any additional fees charged by the host are between you and the host, and Zynetic Electric Vehicles Charging is not responsible for them.

10. Expiry or Closure of Zynetic Electric Vehicles Charging Wallet

You will be informed in advance about the expiry of your wallet. The closure is initiated by you. Unutilized balances can be approached for renewal. If you do not approach us within the specified period, the outstanding balance will be transferred as per RBI guidelines.

11. Prohibition Against Assignment

Your functions, rights, and obligations under this Payment and Refund Policy are exclusive to you and cannot be assigned or delegated to any party or person without our express prior written consent.

12. Dispute and Compensation

To raise a complaint or request a refund, you must contact us within 60 days of the transaction. Claims made beyond this period will not be entertained. Compensation will be processed as per the Compensation Policy set by Zynetic Electric Vehicles Charging.

13. Suspension, Termination, or Cancellation of Zynetic Electric Vehicles Charging Wallet

Zynetic Electric Vehicles Charging may suspend, deny, or terminate your wallet under specific circumstances, including your insolvency, breach of terms, or regulatory restrictions.

14. Indemnity

By using the Zynetic Electric Vehicles Charging Wallet, you agree to indemnify and hold Zynetic Electric Vehicles Charging harmless from any liabilities, claims, damages, and expenses arising from your use of the wallet, breach of these terms, disputes, negligence, or violation of applicable laws or third-party rights.

15. Force Majeure

Zynetic Electric Vehicles Charging is not liable for any harm, loss, damage, or injury caused by circumstances beyond our control, including natural disasters, wars, acts of terrorism, and technological or natural interference.

16. Service of Notice

   Any notice or communication required to be given under this policy should be in writing and sent to legal@zynetic.com.

17. Governing Language‍
18. All correspondence related to this policy shall be in the English language, which is the governing language of this policy.

18. Governing Law and Jurisdiction

Your use of the Zynetic Electric Vehicles Charging Wallet is governed by the laws of India, and you agree to submit to the exclusive jurisdiction of the courts in Dubai. This policy is subject to government notifications, regulatory guidelines, and circulars issued by Zynetic Electric Vehicles Charging and the RBI.

19. Arbitration‍

Disputes arising under this agreement may be resolved through mediation, and if unresolved, will be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

20. Amendment of Payment and Refund Policy‍

Zynetic Electric Vehicles Charging reserves the right to amend, delete, modify, or supplement this policy in compliance with RBI guidelines and applicable laws. We will make efforts to provide prior notice of any changes.
